Who we are
This policy explains how Aether Devices, Inc., a Delaware corporation, of 418 Broadway, No. 4954, Albany, NY 12207, United States (“halite”, “we”, “us”), collects and uses personal information when you visit breathe-halite.com or sign up to hear about halite. We are the business (or “controller”) responsible for that information.
Information we collect
Information you give us. When you reserve or join our list, we collect your email address and the pod you selected, along with which campaign or ad link (if any) brought you to the site, the page you arrived on and the website that referred you. With your signup we also store your approximate location (country, region and city, worked out from your IP address) and your device type, so we can send emails at a sensible local time and know where interest is coming from. If you email us, we collect what you send.
Information collected automatically. Subject to your cookie choices (see below), we and our partners collect information about your device and visit: IP address, approximate location derived from it, browser and device type, pages viewed, the page that referred you, advertising click identifiers, and how you interact with the site (such as clicks, scrolling and mouse movement).
We do not ask for health information, and we ask that you don’t send it to us.
How we use your information
We use personal information to:
- send you updates about halite’s launch, your reservation and related offers (you can unsubscribe at any time);
- operate, secure and improve the website;
- understand how visitors use the site (analytics);
- measure and improve our advertising, and show halite ads to people who have visited our site or are similar to people who have signed up;
- comply with legal obligations and enforce our terms.
Legal bases (UK, EU, EEA and Switzerland). We rely on your consent for marketing emails, analytics and advertising cookies and the related data sharing; on our legitimate interests for running and securing the site; and on legal obligation where the law requires us to keep or disclose information. You can withdraw consent at any time.
Cookies and similar technologies
We use three kinds of cookies and similar technologies:
- Strictly necessary – needed for the site to work, including remembering your cookie choice (
halite_consent) and which privacy rules apply to your region (halite_region). These are always on. - Analytics – Google Analytics (e.g.
_ga) to measure visits and Microsoft Clarity (e.g._clck,_clsk) to produce heatmaps and session recordings of how the site is used. - Marketing – the Meta (Facebook/Instagram) pixel (e.g.
_fbp,_fbc) to measure our ads and build advertising audiences.
If you are in the UK, EU, EEA or Switzerland (or we can’t tell where you are), analytics and marketing technologies only load after you accept them in our cookie banner.
Everywhere else, including the US, they load by default. You can switch them off at any time using the “Your privacy choices” link in the footer of every page. We also treat a Global Privacy Control signal from your browser as a request to opt out of marketing technologies and related data sharing.
Your choice is stored in your browser for up to 180 days, after which we may ask again. Clearing your cookies resets it.
Advertising with Meta
Where marketing technologies are allowed, the Meta pixel tells Meta when you visit pages on our site. When you reserve or sign up, we also send Meta details of that sign-up from our servers (Meta’s Conversions API) so we can measure accurately which ads lead to sign-ups. This includes a one-way hashed (scrambled) version of your email address, your IP address, browser information, the pod you selected and Meta cookie identifiers. Meta uses this to match the sign-up to a Meta account, report ad performance to us, and help show our ads to relevant people.
Meta handles this information under its own Privacy Policy. You can also manage the ads you see in your Meta ad preferences.
Analytics and session recording
Where analytics technologies are allowed, Google Analytics collects information about your visit, and Microsoft Clarity records how you interact with our pages (clicks, scrolling, mouse movement) to create heatmaps and session replays that help us improve the site. Clarity masks what you type, such as your email address, before it leaves your browser. See Google’s Privacy Policy and the Microsoft Privacy Statement.
Who we share information with
We share personal information only with:
- Service providers who process it on our behalf: Vercel (website hosting), Klaviyo (email sign-ups and emails), Google (analytics) and Microsoft (Clarity analytics);
- Advertising partners – Meta, as described above;
- Others where required – to comply with law, protect our rights or users, or as part of a merger, acquisition or sale of our business.
We do not sell personal information for money. However, some US state laws treat sharing information with advertising partners like Meta for cross-context behavioural or targeted advertising as a “sale” or “sharing”. You can opt out of this at any time through “Your privacy choices” or a Global Privacy Control signal. We do not knowingly sell or share the personal information of anyone under 16.
International transfers
We are based in the United States and our service providers may process information in the US and other countries. If you are in the UK, EU, EEA or Switzerland, your information is transferred to the US under safeguards recognised by those jurisdictions, such as the EU-U.S. Data Privacy Framework (and its UK and Swiss extensions) where the recipient is certified, or standard contractual clauses.
How long we keep information
- Sign-up emails: until you unsubscribe or ask us to delete them, or until we no longer need them for the purpose collected.
- Analytics data: according to each provider’s retention settings (for example, up to 14 months for Google Analytics, and around 30 days for Clarity session recordings).
- Advertising data held by Meta: according to Meta’s own policies.
Your rights
US residents. Depending on your state (including California, Colorado, Connecticut, Virginia and others), you may have the right to know what personal information we hold about you and receive a copy, to correct or delete it, and to opt out of its sale, sharing or use for targeted advertising. California residents may also limit certain uses, though we do not use sensitive personal information for purposes that require that right. We will not discriminate against you for using these rights. You may use an authorised agent to make a request on your behalf.
UK, EU, EEA and Swiss residents. You have the right to access, correct or delete your personal information, to restrict or object to how we use it, to data portability, and to withdraw consent at any time. You can also complain to your data protection authority – in the UK, the Information Commissioner’s Office.
How to make a request. Email privacy@breathe-halite.com. We may need to verify your identity before acting, usually by confirming control of the email address involved. We aim to respond within 30 days (45 days where US law allows). If we decline your request, you can appeal by replying with “Appeal” in the subject line, and we will respond within the time the law requires.
Marketing emails. Every marketing email includes an unsubscribe link, or you can email us.
Security
We use reasonable technical and organisational measures to protect personal information, including encrypted connections (HTTPS) and restricted access to our systems. No method of transmission or storage is completely secure, but we work to protect your information and will notify you and regulators of a breach where the law requires.
Children
Our website and products are not directed at children under 16, and we do not knowingly collect their personal information. If you believe a child has given us information, contact us and we will delete it.
Changes to this policy
We may update this policy from time to time. We will post the updated version here with a new “last updated” date and, if the changes are significant, tell you by email or on the site.
