These terms govern your use of breathe-halite.com (the “site”) and the halite waitlist. The site is operated by Aether Devices, Inc., a Delaware corporation, of 418 Broadway, No. 4954, Albany, NY 12207, United States (“halite”, “we”, “us”).

By using the site or joining the waitlist, you agree to these terms and confirm you are at least 18 years old. If you don’t agree, please don’t use the site. Our Privacy Policy explains how we handle your personal information.

When you select “Reserve now”, “Join waitlist” or a similar option and submit your email address, you are joining a free email list to hear about halite. Specifically:

• No payment is taken, and joining the waitlist is not an order, a pre-order or a contract to buy anything.
• It does not reserve, hold or allocate a product, pod or place in any queue for you, and it gives you no right to buy a product.
• Where we say waitlist members will get early or first access to a pre-sale, that is our current intention, not a guarantee. Access may be limited, offered in stages, or offered to some waitlist members and not others.
• You are under no obligation to buy anything, and you can leave the waitlist at any time by unsubscribing.

We may change, pause or close the waitlist, or remove any entry, at any time and for any reason, without notice or liability to you.

halite is a product in development. We do not promise that it, or any pre-sale, will launch at all, on any date, in any country, in any quantity, or in the form shown on the site. We may change or cancel our plans at any time. We are not responsible for any cost, loss or inconvenience arising from a delay, change or cancellation, including where you made plans in anticipation of a launch.

Prices shown on the site (such as $250) are indicative and are not an offer to sell. Final prices, taxes, shipping costs, product specifications, pod options, included items and the countries we ship to will be confirmed if and when a pre-sale opens, and may differ from what is shown now. Images and descriptions are illustrative.

Any future pre-order or purchase will be governed by separate terms of sale presented at the time. No contract of sale exists until you place an order under those terms and we accept it.

Information on the site is for general information only and is not medical advice. halite is not intended to diagnose, treat, cure or prevent any disease or medical condition. Statements on the site have not been evaluated by the U.S. Food and Drug Administration.

Always speak to a qualified healthcare professional before using a new product if you are pregnant or nursing, have a respiratory or other medical condition, or take medication. Don’t ignore or delay seeking medical advice because of anything on the site. References to advisors, research or science describe background and inspiration and are not an endorsement, guarantee of results or clinical claim.

By joining the waitlist you agree to receive emails from halite about the product, its launch and related offers. You can unsubscribe at any time using the link in any email or by contacting us. Unsubscribing removes you from the waitlist.

You agree not to:

• use the site unlawfully, or to mislead, harass or harm anyone;
• submit someone else’s email address or false information, or sign up in bulk or by automated means;
• interfere with, disrupt, probe or attempt to gain unauthorised access to the site or its systems;
• scrape, copy or reuse the site’s content, except as allowed below.

The site and its content – including text, images, video, designs, the halite name and logo – belong to halite or its licensors. You may view the site and share links to it for personal, non-commercial purposes. Any other use requires our written permission. Nothing on the site grants you any licence to our trademarks, designs or patent-pending technology.

If you send us ideas or feedback, we may use them freely without any obligation to you.

The site may link to or rely on services run by others (such as social networks and email providers). We don’t control them and aren’t responsible for their content, availability or practices.

To the fullest extent permitted by law, the site, the waitlist and all content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that the site will be uninterrupted, secure or error-free, or that information on it is complete or current.

To the fullest extent permitted by law, halite and its officers, employees, advisors and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, opportunity or goodwill, arising from or related to the site, the waitlist, or any delay, change or cancellation of the product or a pre-sale.

Because the waitlist is free, our total liability to you for all claims relating to the site and the waitlist is limited to US$50.

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, such as liability for fraud, or for death or personal injury caused by negligence. If you are a consumer in the UK, EU or another country with mandatory consumer protections, these terms do not affect your statutory rights.

To the extent permitted by law, you agree to indemnify halite against claims, losses and reasonable costs (including legal fees) arising from your misuse of the site or your breach of these terms.

We may change the site, and update these terms, at any time. The current version will always be on this page with its “last updated” date. Continuing to use the site or remaining on the waitlist after a change means you accept the updated terms.

These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Albany County, New York, and you consent to their jurisdiction. If you are a consumer living outside the US, you also keep the benefit of any mandatory protections of the law of your country and may bring proceedings in your local courts.

These terms, together with our Privacy Policy, are the entire agreement between you and halite about the site and the waitlist. If any part is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. We may transfer our rights and obligations under these terms; you may not transfer yours.
